1. Acceptance of Terms
By accessing this website or engaging OnCloud Softwares for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site or engage our services.
2. Services
OnCloud Softwares provides custom web development, mobile app development, digital marketing, and related consulting services. The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate written proposal or contract signed by both parties — these Terms govern general site use and do not replace that agreement.
3. Quotes & Payment
Quotes provided through this site or in initial discovery calls are estimates and become binding only once formalized in a signed proposal. Payment terms (milestones, retainers, or fixed-price schedules) are specified per engagement.
4. Intellectual Property
Unless otherwise agreed in writing, full source code and IP ownership for custom-built projects transfers to the client upon final payment. Pre-existing tools, internal frameworks, or white-label products we license (rather than custom-build) remain our property and are licensed to the client for the agreed term.
5. Confidentiality
We treat client project details, business logic, and data as confidential. A mutual NDA is available and signed on request before any detailed technical discussion begins.
6. Warranty & Support
All custom-built projects include a 30-day bug warranty from launch, covering defects in delivered functionality. This warranty does not cover new feature requests, third-party service outages, or issues caused by changes made outside our team after handover.
7. Limitation of Liability
To the maximum extent permitted by law, OnCloud Softwares is not liable for indirect, incidental, or consequential damages arising from use of this website or our services. Our total liability for any engagement is limited to the fees paid for that engagement.
8. Termination
Either party may terminate an active engagement per the notice terms specified in the signed proposal. Work completed and approved up to the termination date remains payable.
9. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts where OnCloud Softwares is registered.
10. Changes to These Terms
We may revise these Terms from time to time. Material changes will be reflected by updating the date below. Continued use of the site after changes constitutes acceptance of the revised Terms.
